The Second Amendment Foundation (SAF) has vowed to take legal action against the New York Police Department (NYPD) in support of former President Donald Trump’s concealed carry license, which was revoked following his conviction in the hush money trial.

SAF’s Executive Vice President, Alan M. Gottlieb, declared that the organization “will challenge the law” to protect Trump’s ownership of firearms. “If Donald Trump is further prosecuted for owning firearms,” Gottlieb stated, “we will offer to defend him and challenge the law.”

SAF’s Stance on Felony Convictions and Gun Rights

SAF believes that individuals should not lose their gun rights due to convictions for non-violent crimes. The foundation’s position aligns with the Supreme Court’s 2022 Bruen ruling, which requires gun laws to have a historical basis at the time the Constitution was written.

According to Gottlieb, “Under the Bruen ruling, Mr. Trump should not lose his Second Amendment rights. There is no historical nexus to deny someone, including Trump, of their gun rights over such a conviction.”

Trump’s Conviction and Gun License Revocation

Trump’s concealed carry license was revoked in April 2023 after he was indicted for the hush money trial in New York. Despite having no history of violent crime, the NYPD’s preparation to revoke Trump’s gun license highlights the need for reform in gun rights legislation.

“The attack on Trump’s gun rights emphasizes the need to revisit existing gun control laws and change them to protect an individual’s gun rights,” Gottlieb observed. “Until that happens, we will be more than happy to meet New York State or the federal government in court.”

SAF’s Track Record and Legal Strategy

SAF has a history of successful legal challenges in the area of gun rights, with 60 cases currently in progress and decisions that have reached the U.S. Supreme Court. The foundation’s motto is “Winning Gun Rights One Lawsuit at a Time,” and they intend to apply this approach to Trump’s case.

“Our goal is to protect and winning Donald Trump’s gun rights,” Gottlieb stated. “We are confident in our ability to defend him.”
