In a shocking turn of events, nine couples are seeking justice against Ovation Fertility, an Orange County IVF clinic, for a harrowing ordeal that involved the tragic loss of their embryos. According to Marcereau Law Group and Ikuta Hemesath LLP, the clinic’s attorneys, the incident unfolded due to a grievous error at their Newport Beach laboratory.
Unfathomable Mistake and Concealment
The plaintiffs allege that in January 2024, the laboratory mistakenly used “lethal hydrogen peroxide instead of distilled water during pre-implantation dethawing procedures.” This grave error not only resulted in the death of their embryos but was compounded by an alleged cover-up attempt.
The lawsuit claims that Ovation Fertility “knowingly implanted dead embryos into would-be mothers and then tried to conceal the laboratory mistakes that had poisoned the embryos.” This deception allegedly involved pressuring patients to sign waivers of legal claims and non-disparagement agreements.
